eBay seeks a highly motivated and technologically-savvy attorney to join the eBay legal team and serve as Director, Head of Patents and Open Source for eBay Inc. This position will have responsibility to counsel technologists and business leaders on a wide array of patent-related and other technology issues. You will also work with internal patent professionals and outside counsel to build and manage the eBay patent portfolio.

  • Work collegially and proactively with various business clients throughout the Company to advise on patents and related intellectual property issues, including invention capture, brainstorming activities, technical analysis of software products, and support for Company innovation programs.
  • Collaborate with, and train developers to balance the needs of the business with risks and obligations associated with various forms of intellectual property protection including patents, trade secrets and open source contributions.
  • Review invention disclosure submissions and assist in decision-making concerning new, continuation, and divisional patent application filings.
  • Analyze patents for all contexts, including acquisition, divestiture, licensing, and litigation.
  • Provide management and oversight of internal and external patent professionals to ensure accurate conduct of patent operations and docketing of matters.
  • Collaborate with, and manage US and international outside counsel in patent filing, prosecution, and portfolio mining activities.
  • Support on patent litigation, M&A activity and other cross-functional projects.
  • Operate against an annual budget.

Job Requirements:

The ideal candidate will be able to perform the above responsibilities successfully and have the following experience:

  • Targeting 10+ years of combined firm and in-house experience in patent-related issues, including preparing and prosecuting patent applications related to software, e-commerce and Internet technologies.
  • Juris Doctorate or equivalent degree, and membership (in good standing) to at least one state bar.
  • Patent bar membership (USPTO registration number) is required.
  • Bachelor of Science degree in a technical field is required, or a degree with an equivalent technical background.
  • A Computer Science degree is highly preferred with an interest in programming, and an ability to discuss code and programming with our developers. Prior experience in software development is a plus.
  • Ability to evaluate, prioritize and execute in a fast paced, demanding and rapidly changing work place.
  • Ability to collegially and collaboratively provide timely advice on general business and technology issues taking into account business goals and IP protection concerns.
  • Excellent written communication, including attention to detail.
  • Excellent verbal communication including in-person and remote (e.g., phone, video conference) discussions.
  • Excellent interpersonal skills including the ability to foster trust and respect and to build friendly and collaborative internal working relationships with internal clients.
  • Knowledge of IP laws generally, and patent laws specifically.
  • Good business acuity.
  • Good sense of humor.
