eBay’s North America Litigation Department is looking for an attorney to provide subject matter expertise in product liability and to manage a wide variety of litigation matters. The attorney will also work cross-functionally with legal and business colleagues to develop policies and procedures both to ensure that eBay remains a safe and trusted marketplace and to mitigate product liability risk. Third-party marketplace liability is an exciting and fluid area of the law. eBay needs a trusted advisor to help navigate changes and litigate matters as they arise. The position offers an outstanding opportunity to run many cases entirely in-house and handle larger cases in partnership with outside law firms.

Job Description:

Track and analyze changes in the law as they occur and keep eBay informed of trends. Partner with eBay's Government Relations team to help influence legislation.

Provide pre-litigation counseling to business partners, with an eye towards avoiding litigation.

Lead all phases of litigation in state and federal court, either alone or with the assistance of outside counsel, including:

  • Developing creative case strategies to resolve cases early and cost-effectively.
  • Running cases from initial pleadings through discovery, motion practice, dispositive motions, and trial.
  • Working with paralegals and internal e-discovery team to satisfy the company’s preservation and production obligations in a time- and cost-efficient manner.
  • Representing eBay at mediations and settlement conferences.

Provide litigation advice to product, employment, intellectual property, compliance, and M&A legal teams.

Collaborate with business partners and other legal groups (e.g., privacy, copyright/trademark, employment, etc.) and in the business (e.g., risk/trust policy teams, prohibited item policy teams) to effectively manage legal risk.

Act as a liaison between eBay and outside counsel.

Provide occasional subject specific legal training to partners.

We will consider applications from candidates who are willing to work from our offices in Draper, UT and Austin, TX. You also must be willing to travel out of state from time-to-time (10% or less).

Requirements:

The right candidate will have a JD, a current bar membership, and 6+ years of litigation experience. Prior experience with the CDA and litigating or counseling in the TCPA space is desirable but not necessary. We’re also looking for excellent writing and editing skills, strong verbal and interpersonal communication skills, excellent organization, and the ability to work independently.

A positive attitude, strong work ethic, and a strong understanding of third party marketplaces and especially eBay are crucial.
